CONDITIONS OF PURCHASE

This agreement governs the general terms and conditions for purchasing tickets sold on this website by PUM TOURS MEDIA SPAIN, S.L. (hereinafter WAH) holder of Tax Identification nº B87691531 and whose address is C/ Alcalá 121, 2o izq. de (28009) Madrid (SPAIN).

When the CLIENT completes the registration process and purchases any of our products, he/she expressly accepts and undertakes to comply with the clauses specified below, as well as with the conditions of access and use of our portal and its privacy policy, accessible via the following link “Privacy Policy”.

The CLIENT hereby acknowledges that he/she has sufficient legal capacity to enter into contract

This contract is accessible at all times in the legal notices on our website.

01. PRICES AND TAXES

By way of consideration for the product purchased, the CLIENT hereby expressly agrees to pay WAH the amounts specified at the time of purchase in the price list published on the website https://wahshow.com/ for the products chosen.

The products offered on this website are subject to Value Added Tax (VAT) which IS INCLUDED in the prices listed for each product.

Before paying for the order, the final purchase price shall appear on the screen, which shall include VAT (Value Added Tax) and processing fees, if applicable, which shall be reflected in the order form at the time of purchase and in the invoice.

 

Anything not specified in the description is not included.

02. PURCHASE PROCESS

Orders may only be made on our website by those over 14 years of age and companies.

All our products are listed individually on the website. The procedure to make and manage the purchase is indicated on the website and only the following steps must be followed:

  1. Choose the product.
  2. By selecting a product, you can add it to your shopping basket and choose whether to continue shopping or to process the order.
  3. To process the order, if it’s the first time you’ve access our portal, you must fill in a registration form with your personal data and create a personal user account. Once this step has been completed, you shall receive confirmation of successful registration at the e-mail address provided. If you’re already registered as a user, to continue with the purchase process all you have to do is log in using the username and password you created in the first purchase. The user code and password are personal and correspond to the person who carried out the registration process, who is exclusively responsible for the safekeeping thereof. Through your account you will be able to manage the information we have and modify or update your data.
  4. The order is then checked, where the selected items are listed one by one and the total price is calculated.
  5. You must also indicate the billing and delivery addresses of the purchase made. You can indicate a single address for invoicing and delivery.
  6. Once the order has been processed, you must check a box to verify that you have read and accepted the terms and conditions of sale.
  7. The website shall provide you with the mechanisms to make the payment depending on the system chosen in each case.
  8. Once you have entered your payment details, you shall need to confirm your order by clicking the ”Buy” button.
  9. Once you’ve clicked the ”Buy” button, you’re order shall be processed.

03. AVAILABILITY AND DELIVERY

The products offered by WAH may be purchased anywhere in the world.

Orders shall be processed once payment has been successfully received.

In order to keep you informed of the progress of your purchase at all times, you will receive an e-mail notification of the confirmation of your order and payment.

The CLIENT can also check the status of their order by sending an e-mail to info@wahshow.com or via our website by logging into your customer account.

04. PAYMENT AND PAYMENT PERIOD

The following payment methods are accepted:

Debit and Credit Card: The transaction is carried out by connecting directly with the payment institution Adyen through its payment gateway.

Once you have made your payment, you will receive a confirmation e-mail.

WAH has no knowledge of your credit card details. All our payment systems are perfectly secure.

Payments are made prior to the delivery of the product or service, so WAH shall not provide the requested product until it has received payment for it. WAH reserves the right to cancel temporarily or definitively the services provided, in the event of any incident regarding the payment thereof.

05. INVOICES

After payment, you shall receive the PDF invoice for your purchase by e-mail if you have expressly indicated this when placing your order.

If you wish to obtain the PDF invoice after the purchase or in the name of your company, please contact customer service (info@wahshow.com) to provide us with the tax information.

The CLIENT shall be responsible for confirming receipt of the notifications and for informing us of any modification to his/her data; WAH shall be held harmless from any liability arising therefrom.

06. WARRANTY

With regard to the services offered by WAH (sale of tickets for WAHSHOW or other events) and given the nature thereof, we are not in a position to offer a guarantee of satisfaction. In the event that, for any reason, you do not receive the product or service correctly, you must inform us forthwith indicating the incident and we shall endeavour, if the error is verified, to correct it as soon as possible.

07. RETURNS

Given the nature of the service covered by this contract, no refunds are possible.

Should the CLIENT receive a ticket that is damaged or has an issue, the CLIENT should contactinfo@wahshow.com to be given a new ticket and/or for the matter to be resolved.

WAH reserves the right to alter or modify the programme. This includes a change of location, within a reasonable distance. Once the ticket has been purchased, it shall only be exchanged or refunded in the event of a cancellation. In such a case, the CLIENT may request a refund within a period not exceeding thirty days from the date of public communication of the cancellation, in the manner specified by WAH. The ticket cost shall not be refunded in the event of cancellation of the event due to force majeure not attributable to WAH.

08. RIGHT OF WITHDRAWAL

Given the nature of the services offered by WAH with regard to the purchase of tickets, services related to leisure activities with a specific scheduled date or period of execution (sale of tickets to WAHSHOW or other events) and in accordance with article 103 point l of the Royal Legislative Decree 1/2007, of 16 November, on the Defence of Consumers and Users, the right of withdrawal is not applicable to this contract.

09. CONCLUDING THE CONTRACT AND MODIFICATIONS TO THE SERVICES

This contract shall be concluded with the payment of the order.

WAH reserves the right to modify, in any way, the characteristics and conditions of its services, always striving to improve them for the benefit of the CLIENT.

10. OBLIGATIONS OF THE PARTIES

WAH hereby undertakes to provide the CLIENT with the products and services that have been contracted, applying the utmost diligence in the provision of the service, as well as to take care of the maintenance of the installations necessary for the operation of the network, having the most adequate technical and computer equipment for this purpose.

The CLIENT undertakes to use the services made available to him/her in good faith, without violating the laws in force in any matter or infringing the rights of third parties, as well as to pay for the selected product in the time and manner set forth herein.

WAH does not guarantee the continuous and uninterrupted availability of the service covered by this contract, due to circumstances caused by problems relating to the Internet network, breakdowns in computer devices and other unforeseeable circumstances. Therefore, the CLIENT hereby agrees to put up with these circumstances within reasonable limits, and therefore expressly waives any contractual or extra-contractual liability before WAH with regard to possible outages, errors and use of the contracted service.

WAH does not guarantee the authenticity of the ticket if it has not been purchased at the official points of sale. Resale of tickets is not permitted. WAH assumes no liability in the event of ticket loss or theft.

11. COMMUNICATIONS

All notifications between the parties shall preferably be carried out by e-mail. The CLIENT shall be responsible for confirming receipt of the notifications and for informing WAH of any modification to his/her data, and WAH shall be held harmless from any liability arising from this circumstance. In the event of modification, the CLIENT must inform WAH by e-mail or telephone numbers indicated on our website.

In accordance with article 21 of Law 34/2002 on Information Society Services and Electronic Commerce, we hereby inform you that our commercial e-mails and information relating to our website and the products offered thereon shall be sent by e-mail to the e-mail address you provide us with, which is always revocable. In any case, you have the option of rejecting our commercial communications by sending an e-mail to the following address info@wahshow.com indicating the word UNSUBSCRIBE.

12. COMMITMENT, ACCEPTANCE AND VALIDITY OF THE CONTRACT

The CLIENT hereby acknowledges to have read and accepted the website’s legal conditions of use and the privacy policy.

THE CLIENT hereby acknowledges that he/she has understood all the information regarding the products and services, including those offered on our website, as well as all the conditions and stipulations set forth herein, and therefore confirms that they are sufficient for the exclusion of error in the consent given to enter into this contract, and therefore fully and expressly accepts them.

THE CLIENT is fully aware that the acceptance and execution of this contract shall come into effect by providing his/her details and clicking on the “Buy” button indicated on our website and shall be concluded the moment the service has been paid for.

13. APPLICABLE LAW

This contract is of a commercial nature, and shall be governed and interpreted in accordance with Spanish law.

Should any dispute arise between the parties in relation to the interpretation, content or execution of the Contract that is not resolved by mutual agreement, the Parties shall submit to the courts or tribunals of the domicile of the CLIENT, provided that the CLIENT is acting as a consumer.

In cases in which it is foreseen that the parties may submit to a jurisdiction, they shall submit to the Courts and Tribunals of the city of Madrid (Spain), expressly waiving any other jurisdiction that may correspond thereto.
